Air Transport (Licensing of Air Services) Regulations, 1964 Details Description This regulations include the license and permit requirements and the associated fees for the provision of air transport services in Tuvalu as made under Section 13 of the Civil Aviation Act, 1949. This Part shall not apply to the carriage of passengers, mail or freight by air for hire or reward upon journeys other than scheduled journeys (Clause 3). Subject to the provisions of the Regulations, it shall not be lawful for any person to use any aircraft for the carriage in Tuvalu of passengers, mail or freight for hire or reward upon any scheduled journey between 2 places, of which at least 1 is in Tuvalu, except under, and in accordance with the provisions of, a licence or a provisional licence granted by the Licensing Authority (Clause 4). Alcoholic Drink Act Details Description This regulation outlines the various types of licenses one can acquire and the conditions to be complied with for the purpose of manufacturing and selling alcoholic drinks in Tuvalu. The fees payable in respect of the matters listed in the Schedule are as specified in the Schedule (Clause 14). There are the following classes of licences (Clause 12) — (a) off-licences (more particularly dealt with in Division 2); (b) hotel-keepers’ licences (more particularly dealt with in Division 3); (c) publicans’ licences (more particularly dealt with in Division 4); (d) club licences (more particularly dealt with in Division 5); (e) restaurant licences (more particularly dealt with in Division 6); (f) ships’ licences (more particularly dealt with in Division 7); (g) aircraft licences (more particularly dealt with in Division 8); (h) occasional licences (more particularly dealt with in Division 9); (i) sour toddy producers’ licences (more particularly dealt with in Part V); [...] a licence (other than a sour toddy producer’s licence) may authorise the sale of alcoholic drinks generally or the sale of beer and sour toddy only. The only licences that authorise the sale of sour toddy are hotel-keepers’ licences; and publicans’ licences; and sour toddy producers’ licences [...]. A person who, except as authorised by or under any other Act (Clause 90) — (a) imports or sets up a still; or any machinery, implement or utensil used for the distillation of spirits; or (b) has in his possession or custody, or under his control a still, still head or worm; or any machinery, implement or utensil used or intended for use in connection with the distillation of spirits; or (c) makes any spirits, or assists or is otherwise concerned in making spirits; or (d) supplies materials for making or working a still; or (e) conveys or conceals, or assists in conveying or concealing, any spirits distilled or made in Tuvalu, will be liable for punitive actions. Arms and Ammunition Act Details Description Under this regulation, import and export licences are necessary for arms and ammunitions or part of arms and ammunitions. Also, no person shall manufacture any arm or ammunition except at an arsenal established with the approval of the Minister and in accordance with instructions to be issued by him (Clause 3). However, this does not include the repair of arms, the conversion into an arm of anything which has the appearance of an arm which is so constructed as to be incapable of discharging any missile through the barrel thereof, or the alteration, substitution or replacement of any component part of an arm. No person shall possess, use or carry any arm or ammunition except under a licence in respect of each arm and such ammunition so possessed, used or carried and in accordance with the prescribed conditions of such licence (Clause 4). No person shall import any arm or ammunition or part of arms and ammunition unless he holds a licence in that behalf [...] (Clause 12). No person shall export any arms or ammunition from Tuvalu to a place outside Tuvalu unless he holds a licence in that behalf (Clauses 14 and 16). Affected products Arms and ammunitions. Biosecurity Regulations Details Description This document outlines a comprehensive set of rules established to prevent the introduction and spread of plant and animal diseases and pests. Cinemas and Films Act Details Description This regulation includes provisions for licensing, certification and permit requirements that must be met to exhibit films in cinemas in Tuvalu. Civil Aviation Act, 2006 Details Description This regulation provides for the regulation and promotion of civil aviation in Tuvalu to foster its safe development. The Director shall monitor and enforce compliance with the provisions of Annex 18 to the Chicago Convention on International Civil Aviation Organisation Technical Instructions for the Safe Transport of Dangerous Goods by Air, and is authorised to submit variations to the Technical Instructions on behalf of Tuvalu where necessary (Clause 17). A civil aircraft shall not operate in Tuvalu unless it is registered in Tuvalu or is registered under the laws of a foreign country (Clause 19). An application for an airman and air operator certificate shall be made to the Director, which shall contain such terms, conditions, and tests of physical fitness, and other matters as the Director may determine to be necessary to assure safety in civil aviation (Clauses 22 and 24). The owner of an aircraft registered in Tuvalu may file with the Director an application for an airworthiness certificate for the aircraft (Clause 23). No air operator shall engage in any commercial air transport unless there is in force an air service licence issued by the Minister authorising the air operator to engage in air transportation (Clauses 32 and 33). Companies and Business Registration Act Details Description Under this regulation, every company or partnership which has established or shall establish a place of business in Tuvalu or which derives profits from any enterprise or operation in Tuvalu shall file with the Minister the following documents: (a) a certified copy of the charters, statutes or memorandum and articles of the company or other instrument constituting or defining the constitution of the company, or, in the case of a partnership, a copy of the deed or agreement creating such partnership or written evidence of the terms upon which such partnership exists and which, in the case of such partnership having foreign interests, clearly sets out that such interests carry a maximum of 20% of all assets and profits that may be derived or accruing from the operations of such partnership in Tuvalu, and if the relevant document is not in the English language, a certified translation thereof in English; (b) a list of directors of the company or of the partners in the partnership, as the case may be; (c) the names and addresses of one or more persons resident in Tuvalu authorised to accept on behalf of the company or partnership service of process or of any notices required to be served on the company or partnership or on any partner in respect of partnership business. There are also limit on foreign interests, such as: (1) No partnership shall have foreign interests greater than such percentage of each of — (a) all assets; and (b) all profits that may be derived or may accrue from the operations of the partnership in Tuvalu, as the Minister may by regulations prescribe, either subject to prescribed conditions or unconditionally. Consumption Tax Act Details Description Under this regulation, consumption tax shall be levied on a taxable supply by a taxable person; and a taxable import within the range of 3% - 10% (Clause 5). Concrete rates are specified in the regulations. The following supplies shall be exempt from Consumption Tax (Clause 6) - (a) medical, dental, nursing and health services; (b) education services; (c) financial services; (d) lease of land for residential purposes; (i) any other type of good or service as determined by the Minister by Regulation. (2) The following taxable supplies shall be subject to a zero rate of consumption tax: (a) an export of goods; (b) an export of services for use outside Tuvalu; (c) a supply of international transport of goods or passenger services from a place outside Tuvalu to another place or if the transport or part of the transport is across the territory of Tuvalu; (d) the supply of goods as part of the transfer of part or whole of a business as a going concern by a registered person to another registered person, provided that the supplier and recipient have — (i) agreed in writing that part or whole of the business is supplied as a going concern; (ii) notified the Taxation Officer, in writing, of the details of the transfer, at the date of the transfer on which Consumption Tax has been credited as input tax. The following shall be exempt from consumption tax — (a) imports by a government entity, other than a public enterprise; (b) imports not exceeding $25 in value accompanying a person arriving in Tuvalu; (c) imports by diplomats according to law. . Copra Act Details Description Under this legislation, only a designated society or person authorised by the designated society or by the Minister can export specified coconut products. Also, only designated societies can purchase all copra products of fair merchantable grade and all specified coconut products. However, neither the designated societies nor the copra products that are considered to be fair merchantable grade are specified in the Act. Counter Terrorism and Transnational Organised Crime Act, 2009 Details Description This regulation seeks to to implement the United Nations Security Council Resolutions and Conventions dealing with terrorism and transnational organized crime; to prevent terrorists from operating in Tuvalu; and prevent persons in Tuvalu from taking part in terrorist activities or supporting terrorism. Any person must not knowingly offer to provide, or provide, a weapon or explosive or other lethal device to a specified entity; o a member of a specified entity; or any other person for use by, or for the benefit of, a specified entity or a member of a specified entity (Clause 16). Dangerous Drugs Act Details Description This regulation outlines the prohibited drugs that can't be imported into, exported from or manufactured in Tuvalu and the various certifications required for import and export of dangerous drugs as listed in Schedule 2 of this Act. Also, no person shall import, export, tranship or divert dangerous drugs except through ports approved by the Minister (Clause 3). No person shall import or export: - raw opium, coca leaf and Indian hemp and resins obtained from Indian hemp and preparations of which such resins form the base (Clause 4); - any seed of the opium poppy or any seed of Indian hemp or any seed of the coca leaf or any portion of the aforesaid plants (Clause 5); - any prepared opium, or any pipes or other utensils for use in connection with the smoking of opium, or any utensil for use in connection with the preparation of opium for consumption (Clause 11); - any substance to which this Part applies, except in accordance with sections 21 to 29 (Clause 14). No person shall cultivate in Tuvalu the opium poppy or Indian hemp or coca leaf plant (Clause 7). All dangerous drugs to which this Part applies imported into Tuvalu shall be deposited at the cost, risk and peril of the persons importing the same, in such store as shall be appointed by the Minister for that purpose (Clause 16). Upon the production of an import certificate duly signed by the competent authority in any country, the Senior Medical Officer may issue an export authorisation, in the Form B set out in Schedule 1[....] to any person who is named as the exporter in such certificate [....] (Clause 21). No dangerous drug shall be exported unless the exporter is in possession of a valid and subsisting export authorisation relating to such drug granted under this Act (Clause 22). No dangerous drug shall be imported unless the person to whom the drug is consigned is in possession of a valid and subsisting import authorisation granted in pursuance of this Act (Clause 27). Every dangerous drug imported from a country which is a party to the Convention or the Single Convention shall be accompanied by a valid and subsisting export authorisation or diversion certificate (Clause 28). No person shall bring any dangerous drug to Tuvalu in transit unless (Clause 31)— (a) the drug is in course of transit from a country from which it may lawfully be exported to another country into which such drug may lawfully be imported; and (b) except where the drug comes from a country not a party to the Convention or the Single Convention, it is accompanied by a valid and subsisting export authorisation or diversion certificate, as the case may be. Dogs Amendment Act, 2019 Details Description This Act amends various provisions of the Dogs Act, 1919. Energy Efficiency Act Details Description This Act applies to new and second hand products of product class subjected to this Act imported by a consumer for personal use (Clause 9). The importer can only import products prescribed in Schedule IA and IB of the Regulations that meet the following conditions (Clause 11): 1. The brand and model should be registered under the Act 2. The energy label should comply with the energy performance standards and methods of testing provided under the Schedule IA for that product. 3. The product's energy label should be displayed at the front of the product. 4. The energy performance characteristics of the product on the label should correspond to the those of the registered model. The product should only have one label as specified in schedule IB. A person who intends to import, offer to supply or supply a product subject to this Act and specified under Schedule 1A and 1B of the Regulations must not do so unless the brand and model of the product is registered under Part VI; and the product complies with the standards required for that particular product class as specified under Schedule 1A and 1B (Clause 13). Environment Protection (Litter and Waste Control) Regulations Details Description Under this legislation, when any hazardous wastes are imported into Tuvalu, a person must comply with international obligations under the Stockholm Convention; the Waigani Convention; and any other waste-related convention in the future. Environment Protection Act Details Description This Act provides for the establishment of offices and functions for the Minister for Natural Resources and Environment, Director of the Department of Environment, National Environment Council, Environment Officer; and the various measures to be undertaken for the protection of the environment in Tuvalu. Explosives Act Details Description This legislation states that a dealer's licence is needed to import, keep for sale, sell, supply or deal in explosives (Clause 3). Additionally, no person shall have explosives in his possession or under his control, or use the same, except in pursuance of a licence hereinafter called a holder’s licence. A licence fee is $10. Also, a dealer's licence holder should keep a record of each sale. A holder’s licence may be issued for any period not exceeding 6 months and shall contain a statement of the purposes for which the explosives to which it relates may be used. Falekaupule Act, 1999 Details Description This regulation applies to island communities of Falekaupule. Under this regulation, the Falekaupule listed in Schedule 1 is established and states that it will have authority in the areas specified in that Schedule in respect of each Falekaupule. Harbours Act, 1957 Details Description This regulation includes the license requirements relating to pilots, occupations at the foreshores for certain purposes, harbours and shipping therein (Clause 15). Importation of Animals Act, 1919 Details Description This legislation states that dogs must be imported from designated ports into Tuvalu with a licence. Lagoon Shipping Act, 1958 Details Description This regulation outlines the various examination, certification and license requirements that must be met by masters, mates or engineers of foreign going vessels or trading vessels for shipping services in lagoons and inland waters of Tuvalu (Clauses 6 and 8). Lagoon Shipping Regulations, 1958 Details Description This regulation states that every lagoon shipping vessel shall be assigned to a class shown in Schedule A and shall comply with all the regulations for a vessel of her class. Marine Resources Act Details Description This regulation seeks to ensure the long-term conservation and sustainable use of the living marine resources for the benefit of the people of Tuvalu. A permit is required for (Clause 13) domestic-based fishing; foreign fishing; commercial fishing; commercial pilot fishing; marine scientific research activities; transhipment; or such other fishing or other activities, transhipment, or such other fishing activity related to fisheries. Pesticides Act Details Description This legislation states that (Clause 7) no unregistered person shall supply, sell, offer for sale or use any pesticide in Tuvalu; or import any pesticide without an import permit. Any person desiring to import a registered pesticide may apply in the prescribed form to the Registrar for an import permit (Clause 10). However, substances or mixtures of certain elements or compounds, the importation of which is prohibited by this Act, [.....] shall be deemed to be goods the importation of which is prohibited under the Customs Act [...] (Clause 11). Petroleum Act Details Description This regulation states that the master of any craft with a cargo consisting wholly or in part of petroleum, shall from the time such craft enters any port in Tuvalu, or from the time any petroleum is placed on board of such craft [....], conform to such directions in respect of the place at which it is to be moored, loaded or discharged as may be issued generally for all such craft or specially for any such craft by the harbour master, Customs Officer or other proper officer of the port (Clause 3). Pharmacy and Therapeutic Products Act Details Description Under this legislation, in order to import any therapeutic product, the product must be on the Tuvalu Medicines Schedule and it must be approved by a recognised regulator in terms of quality, safety or efficacy. Also, an importer, manufacturer, seller, pharmacist of such products must be authorised by the licensing authority under Clause 21 (National Drugs and Therapeutics Committee). Unless authorised by the licensing authority, no person may import, manufacture, sell, supply or promote any therapeutic product unless that product has been approved by a recognised regulator and is on the Tuvalu Medicines Schedule (Clause 10). Donated medicines may only be imported into Tuvalu if they comply with Tuvalu’s Guidelines for Donations of Medical Supplies prepared by the Ministry of Health (Clause 13). Plants (Prevention of Disease and Pests) Regulations, 1965 Details Description This regulation identifies the pests and plant diseases for which containment and disinfecting measures need to be undertaken as outlines in the Plants Act, 1977. Plants (Shipping) Regulations, 1976 Details Description Under this regulation, the master of any vessel which has within the past 20 days called at any place from which the importation of plants is prohibited by order under section 4 of the Plants Act, 1977, shall immediately upon arriving at Tuvalu, make a declaration to the Agricultural Officer that he has within 12 hours of leaving such prohibited place(s), he has personally inspected the vessel and removed all plants that are included under prohibition measures. Plants (Spraying of Aircraft) Regulations, 1977 Details Description Under this regulation, where an aircraft arrives in Tuvalu from a place outside Tuvalu, the cockpit and passenger compartments; the hold and baggage compartments; and any other part of the aircraft decided on by a quarantine officer, shall be sprayed with insecticide as directed by, and to the satisfaction of a quarantine officer. Plants Act, 1977 Details Description This regulation prohibits of the importation of certain plants (Clause 4) for the purpose of protecting agriculture and livestock in Tuvalu from outside pests and plant diseases. Save with the express authority in writing of the Agricultural Officer, no plant shall be imported into Tuvalu except through the port and airport of Funafuti or such other ports or airports that are designated as such by the Ministry of Agriculture (Clause 5). The fees set out in Schedule 2 shall be paid by or on behalf of any person wishing to export plant or plant material for the services performed and the issue of a certificate in pursuance of section 14(3). No plant shall be imported into Tuvalu (Clause 6) [....] unless a permit has been obtained under section 14(1); and such a plant is accompanied by a certificate in accordance with Form A as set out in Schedule 1, that certifies it to be free from plant disease or pests, and signed by an official authorised to issue such certificates in the country in which the plant was produced or whence it was imported. Prohibition of Importation of Plants Order, 1977 Details Description This regulation states the specific plants whose imports from specific countries and regions are prohibited. Public Health Regulations, 1926 Details Description This regulation states includes measures that intends to safeguard public health and sanitation in Tuvalu. It includes cleanliness and inspection standards for all premises; stagnant water and its collection (tins, tanks, boats, etc.); guttering and down-pipes; latrines and its cleaning; disposal of rubbish; and prohibits dumping of rubbish in streets, etc. Additionally, all persons who sell or deal in food-stuffs of a perishable nature shall keep such food-stuffs properly protected from flies; and if a sanitary inspector be satisfied that any such food-stuffs have not been so protected he may order the immediate destruction thereof without payment of compensation (Clause 16). For mineral water and ice-cream, only boiled or efficiently filtered water shall be used in operations connected with the manufacture and bottling of aerated waters and the making of ice cream offered for sale (Clause 17). Television Licence Regulations, 1994 Details Description This regulation states that subject to the certain provisions, the Tuvalu Telecommunications Corporation may grant to any person or group of people a (commercial, non commercial and provisional) television licence to provide a television services. A holder of a television licence in the form of a commercial licence shall be entitled to provide a television service to the public. A holder of a television licence in the form of a non-commercial licence shall be entitled to use a television service for his or her personal use only. A licensee who intends to construct, build, or otherwise acquire and operate a satellite dish or earth station for the purpose of transmitting a television service shall, at his own expense, carry out an environment impact assessment prior to the commencement of such activities. An applicant for a television licence will need to have a sound technical knowledge and know how of television or related technical and managerial experience; and submit an application for a television licence in the form prescribed by the Corporation from time to time. Tuvalu Seabed Minerals Act Details Description This Act establishes a legal framework for the efficient management and development of Tuvalu’s Seabed Minerals; and shall regulate the prospecting, exploration and mining of Tuvalu’s seabed minerals, and the sponsorship by Tuvalu of exploration and mining of seabed minerals in the Area. However, this Act does not apply to the exploration for or recovery of petroleum. United Kingdom Designs Protection Act Details Description Under this regulation, subject to the provisions of this Act, the registered proprietor of any design registered in the United Kingdom under the Registered Designs Acts 1949 to 1961 or any Act amending or substituted for those Acts, shall enjoy in Tuvalu the like privileges and rights as though the certificate of registration in the United Kingdom had been issued with an extension to Tuvalu. Wastes Operations and Services Act, 2009 Details Description This regulation defines the roles and responsibilities for waste management in Tuvalu; fees and charges for waste management services; requirement for registration and licensing of private waste operators; and contracted waste services in Tuvalu. 5. Waste management operations in Tuvalu: (1) Waste management authorities designated under section 15 shall be responsible for the provision of waste collection services to residential and commercial premises in accordance with the provisions of Part IV. (2) The collection and disposal of wastes that cannot be managed by the provision of normal waste collection services to residential and commercial premises shall be undertaken by the Solid Wastes Agency in accordance with its functions and powers under this Act, and any other law relating to the management of wastes. (4) The storage and disposal of hazardous wastes shall be undertaken by the Solid Wastes Agency and the designated waste management operators in accordance with its functions and powers under this Act. (6) The collection and disposal of medical wastes shall be the responsibility of the Ministry of Health. 11. Controls over certain wastes: (1) Regulations made under this Act may impose requirements in relation to certain wastes having adverse impacts on the environment or human health by – (a) imposing prohibitions in relation to the importation, exportation, manufacture, use, storage or transportation of certain objects, substances or things which may become wastes; (b) regulating the importation, exportation, manufacture, use, storage or transportation of certain objects, substances or things which may become wastes, and imposing conditions in relation to them; (c) requiring the lodging of a deposit in relation to certain objects, substances or things which may become wastes to ensure their appropriate disposal by recycling or otherwise; or (d) imposing obligations on persons importing, exporting, using or manufacturing certain objects, substances or things which may become wastes in relation to their eventual disposal. (2) Regulations made under subsection (1) may prescribe any matter necessary for the protection of the environment or human heath from objects, substances or things which may become wastes, and any matter concerning the administration of any scheme requiring the lodging of deposits or obligations to dispose of such objects, substances or things. 12. Registration and licensing of private waste operators: (1) This section does not apply to the operations and services of designated waste management operators. (2) All landfill sites, waste dumps and waste disposal facilities in Tuvalu must be licensed by the Solid Wastes Agency, which may impose any conditions in relation to the operation of the site, dump or facility under the licence. (3) The registration and licensing of other waste management operations or services may be required in accordance with Regulations made under this Act. 20. Wildlife Conservation Act, 1975 Details Description The Minister can make orders for the full or partial protection of any bird or animal in a designated area or areas in Tuvalu. Every reference to part of a fully or partially protected bird or other animal shall include a reference to the meat thereof; and the skin or shell thereof or any part thereof howsoever cured, treated, polished, carved or otherwise worked. However, concrete lists of fully or partially protected bird or animals do not exist. Hunting, searching for eggs and nests, and the possession of protected birds and other animals without a license is prohibited in Tuvalu. No person shall hunt, kill or capture any fully protected bird or other animal in its designated area or acquire or dispose of to another person any fully protected bird or other animal unlawfully killed or captured or any part or product of such a bird or animal except under and in accordance with the terms of a valid written licence granted to that person by the Minister under this subsection (Clause 5). Similarly, no person shall search for, take or wilfully destroy, break or damage the eggs or nest of a fully protected bird or other animal (Clause 6) without a valid license either.
